By accessing or using the website you agree to be bound by these Terms of Use ("Terms"). If you do not agree, please do not use the website.

You may use this website for lawful, personal and business purposes only. You agree not to:

• Submit false, misleading or fraudulent information through any form
• Scrape, mirror, or systematically harvest content using automated tools without our written consent
• Attempt to gain unauthorised access to any part of the website, server, or network

You may view, download for caching purposes only, and print pages from the website for your personal and internal business reference only. Any other use — including republishing, redistribution, modification, or commercial exploitation — requires written permission.

When you submit a contact form, quote request or job application, you confirm that:

• The information you provide is true, accurate and complete
• You have the authority to submit the information (including, for B2B enquiries, on behalf of the company you represent)
• You consent to NativeWay processing the data per our Privacy Policy

Submitting an enquiry or quote request does not create a binding contract. A binding agreement is formed only when NativeWay issues a signed written contract or accepted purchase order.

6. Disclaimers

The website is provided "as is" and "as available". To the fullest extent permitted by law, NativeWay disclaims all warranties — express or implied — including but not limited to merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted availability.

Engineering content (heat-load calculations, capacity tables, technical specifications) is provided for general guidance and does not replace project-specific design by a qualified engineer.

7. Limitation of liability

To the fullest extent permitted by Sri Lankan law, NativeWay's total liability to you for any claim arising out of or relating to the website (whether in contract, tort, statute or otherwise) is limited to the amount you have paid to NativeWay in the twelve months preceding the claim, or LKR 1,000 if no payment has been made.

NativeWay is not liable for any indirect, incidental, consequential, special, punitive or exemplary damages, including but not limited to lost profits, business interruption, loss of data or loss of goodwill, even if advised of the possibility of such damages.

8. Third-party websites & links

The website may contain links to third-party websites (e.g., Hitachi, Teksan, supplier sites). We provide these for convenience only. We do not endorse and are not responsible for the content, privacy practices or terms of those sites. Visit them at your own risk.

9. Indemnification

You agree to indemnify, defend and hold harmless NativeWay (Pvt) Ltd., its directors, employees and agents from any claim, liability, damage or expense (including reasonable legal fees) arising from your breach of these Terms or your misuse of the website.

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent change. Continued use of the website after a change constitutes acceptance of the revised Terms. Material changes will be communicated via a banner on the website for at least 14 days.

11. Severability

If any provision of these Terms is held invalid or unenforceable by a competent court, that provision will be enforced to the maximum extent permissible and the remaining provisions will continue in full force.

12. Governing law & jurisdiction

These Terms are governed by the laws of Sri Lanka. Any dispute, controversy or claim arising out of or relating to these Terms, the website, or any related transaction shall be submitted to the exclusive jurisdiction of the courts of Colombo, Sri Lanka.
